Personal Injury Misconceptions

Many people tell others what they can or cannot do when it comes to an injury claim. They even inform them about how to proceed through the matter. While some things may be true it is important for the person with the claim to do their own research. By researching you find the fact and know what is true and what is fault and what affects your case. This article and a subsequent one will discuss some personal injury claim misconceptions.

Many people think that insurance is enough, therefore, they do not need to hire a lawyer. In some situations, this may be true, however, there are instances where the insurance carrier refuses to pay a settlement. Or other instances where they offer a much lower amount or do not communicate at all. It is in such situations that you need to hire a lawyer. The lawyer will help to determine whether the claim is valid or not and continue communicating with the insurer. In instances where the settlement is too low, the lawyer may be able to deal with the insurance company successfully. When such actions fail the lawyer will help you pursue a claim in court. This will ensure that you get the compensation you deserve.

Some think it’s best to hire a lawyer later on after filing the documentation on their own for the claim. While this may be a good idea, there is a timeframe set for filing personal injury claims. This timeframe is called the statute of limitations. If this deadline passes then you will not have a chance of making a claim and getting the needed compensation. This misconception may cost you your claim. By hiring a lawyer and initiating the claim quickly, this increases the strength of the case. Additionally, the lawyer is able to work in the background while you recover in the hospital or at home.
