Compensation for personal injury is important in order for the victim to recover. Compensation allows the Victim to pay medical bills and provide for daily living when they are unable to work. In Florida a personal injury claim arises due to negligence that results in harming the Victim. This article will discuss the types of damages and compensation in a personal injury case.

The defendant pays the victim damages for the actual injury and other involved issues related to the accident. The defendant, therefore, holds liability in the accident. Such liability can be as a result of the following:

  • Intentional harm to the person
  • Negligence, or
  • A breach in the duty of care in some way

In order for the victim to succeed in receiving compensation it is necessary to prove that the defendant is responsible. This responsibility is for the damages or injuries suffered by the Victim so as to recover compensation. The claim may also prove that another party holds some fault such as a:

  • Manufacturer
  • Distributor, or
  • Another company connected to the incident

Types of Damages

There are three types of damages possible in a personal injury claim in Florida. These damages are:

  1. Economic damages or losses – These include those items that result in loss of money. For example, medical costs, a loss of wages from work and something of value such as property damage.
  2. Non-economic damages – These are losses that require a calculation of something that could involve pain and suffering or lower quality of life
  3. Punitive damages – These include compensation from the judge to punish the defendant for shocking and awful acts against victim.

It is important to note that there are other types of compensation that may be awarded including the above mentioned.
