A few basic steps must be followed when filing a personal injury claim . This is in order to bring an injury-related insurance claim or lawsuit after an accident. This article and subsequent ones will discuss some of these basic steps.
Firstly, there are almost as many different kinds of personal injury cases as there are different ways of getting injured. There are car accidents, slip and fall accidents, medical malpractice, products liability, etc. Personal injury law covers a broad range of incidents; therefore, no two cases follow the exact same timeline or course. The manner in which a case follows depends on the severity of the injuries that result from the incident. As well as clarity on certain issues. Further, whether the incident is covered by an insurance policy or not affects how the personal injury case plays out.
Three Basic Steps
Below are three key elements relating to a personal injury claim:
- Insurance policy coverage
If you have suffered injury, you may feel that someone else is legally responsible for it. It is important to determine whether or not that person has insurance to cover your injury claim. So, for example, in the case of a car accident, does the other driver have insurance? This is important because it informs what you’re able to collect as damages if the personal injury trial is successful.
If a jury gives a favorable judgement of $1 million, it means nothing if the defendant has no insurance coverage. Worse still if the defendant owns very little to no assets. A solution, take the time and consider the extent of your injuries and whether your own insurance can cover it. However, if your injuries are serious and the other person is clearly at fault you likely will want to proceed. Regardless, of insurance coverage or not.
